VERSUS

THE STATE OF ASSAM

REPRESENTED BY THE SPL PUBLIC PROSECUTOR, C.M. VIGILANCE

Advocate for the Petitioner : MS. KABERI K DAS, MR. RITUPAM MALI

HONOURABLE MR. JUSTICE RAJESH MAZUMDAR

ORDER

Date : 14.10.2026 Heard Ms. K.K. Das, learned counsel for the petitioner and Mr. P. Kataki, learned senior counsel and Special PP, assisted by Ms. M. Kashyap, learned counsel for the State. The learned senior counsel and Special PP has submitted that the preliminary enquiry being allegation No. 111 of 2026 has culminated in a report which has been forwarded to the Superior authority and at the present there is no such complaint or Page No.# 2/2 case in which the petitioner may apprehend arrest. He has prayed for closure of the Anticipatory Bail application. The learned counsel for the petitioner has submitted that during the enquiry proceedings, her brother had also been called for participating in the preliminary enquiry and this Court having noticed that no criminal case had yet been registered, had observed that the participation of the brother of the petitioner would be as a witness in the preliminary enquiry and would be without subjecting him to any coercive action. Since the learned senior counsel has made a statement that the preliminary enquiry is closed, the anticipatory bail application is closed with an observation that the petitioner shall not be subjected to any coercive action without registration of a case.
