ORDER

13.10.2026 Heard Mr S Haque, learned counsel for the petitioner. Also heard Mr R J Baruah, learned Additional Public Prosecutor for the State of Assam.

2. By this application, the petitioner has prayed for bail in connection with Bhuragaon PS Case No. 90/2026, under Sections 351(3)/152/61(2)/352/196/353(2) of the BNS, 2023.

3. The FIR in connection with which the petitioner was arrested on 15.08.2026, was Page No.# 2/2 lodged by the Police personnel of Bhuragaon Police Station, stating, inter alia, that during monitoring of social media platform, it was noticed that the petitioner had used his Facebook account and posted a highly objectionable comment against the Hon’ble Chief Minister of the State.

4. The learned counsel for the petitioner submits that the petitioner is not the one, who had posted the comment on his Facebook account, but another accused person had posted it.

5. On the other hand, Mr R J Baruah, learned Additional Public Prosecutor, on the perusal of the Case Diary, submits that the petitioner had posted the articles in his own account and it is not possible for someone else to use the Facebook account of the petitioner and post comments on the same.

6. Upon consideration of the submissions made by the learned counsels, more so, in view of the serious comments made against the Executive Head of the State along with various other comments, which were made by the petitioner himself in his social media account, this Court does not deem it fit to enlarge the petitioner on bail at this stage.

7. Bail Application is dismissed and disposed of.

8. Send back the Case Diary.
