ORDER

Date : 13.10.2026

Heard Mr. M. P. Sarma, learned counsel for the applicant. Also heard Mr. R. Sahini, learned counsel appearing on behalf of Mr. D. Nath, learned counsel for the respondents/opposite parties. This is an application praying for impleadment of the new incumbents, namely, Shri Sanjib Shyam, Commissioner & Special Secretary to the Government of Assam, Public Works (Roads) Department, and Shri Debajit Das, Secretary to the Government of Assam, Public Works (Roads) Department, as alleged contemnor Nos. 5 & 6, respectively, in the connected contempt petition, being Cont. Cas(C) No. 20/2025. The applicant has filed the aforesaid contempt petition alleging willful and deliberate violation of the direction of this Court dated 18.06.2024, passed in WP(C) No. 5129/2014, wherein the earlier incumbents have been arrayed as alleged contemnors. It is submitted that during the pendency of the contempt petition, the earlier incumbents have been transferred and in their places, the officers who are sought to be impleaded have been posted. Therefore, the applicant seeks impleadment of the new incumbents in the connected contempt petition. Having considered that the officers sought to be impleaded would be a necessary party in view of the fact that they have been posted as Commissioner and Special Secretary as well as Secretary to the Government of Assam, Public Works (Roads) Department, I am of the view that the aforesaid 2 (two) officers are required to be impleaded as parties in the contempt petition. Thus, I deem it appropriate to allow this interlocutory application. Accordingly, Shri Sanjib Shyam, Commissioner & Special Secretary to the Government of Assam, Public Works (Roads) Department, and Shri Debajit Das, Secretary to the Government of Assam, Public Works (Roads) Department, are allowed to be impleaded as alleged contemnor Nos. 5 & 6, respectively, in the connected Cont. Cas(C) No. 20/2025. The interlocutory application stands disposed of. JUDGE Comparing Assistant
