ORDER

Date : 13.10.2026

Heard Mr. S. Borthakur, learned Counsel for the petitioners and Mr. RJ Baruah, learned Additional Public Prosecutor for the State.

2. By this application, the petitioners have prayed for bail in connection with

Laluk PS Case No. 182/2026 registered under Sections 109(1)/118(2)/3(5) of BNS, 2023. The FIR in connection with which the petitioners were arrested on 28.08.2026 was lodged by the father of the victim stating inter alia that when his son was on his way home, the petitioners stopped his scooty and attacked him with sharp weapons as a result of which, his son sustained injuries and was admitted in the hospital.

3. The learned Counsel for the petitioners submits that there was a mutual fight and FIR was also lodged by the mother of the petitioners, which however was not registered by the police officials of the concerned Police Station.

4. Mr. RJ Baruah, learned Additional Public Prosecutor for the State on the other hand submits that the Case Diary be called in order to see the complicity of the petitioners and he submits that the FIR shows that the petitioners have attacked the son of the informant.

5. Upon consideration of the submissions made by the learned Counsel for the parties, more so, in view of the fact that there was a cross FIR by the mother of the petitioners alleging that the petitioners were attacked by some unknown persons of Missing community and also due to the fact that the petitioners have been inside the jail for a considerable period of time, this Court deems it fit to enlarge the petitioners on bail on furnishing of bail bond of Rs. 20,000/- each with one local surety each of the like amount to the satisfaction of CJM, North Lakhimpur, Lakhimpur under the following conditions:

i) the petitioners will appear before the Investigating Officer as and when called for.

ii) the petitioners will not hamper, tamper with the evidence, neither influence the witnesses connected with the case.

iii) the petitioners will not leave the place of jurisdiction without the permission of the concerned Court.

6. Petition is disposed of.
