HONOURABLE MR. JUSTICE RAJESH MAZUMDAR

ORDER

Date : 12.10.2026 (K.R. Surana, J) Heard Mr. M. Alom appeared as learned counsel for the applicants. Also heard Mr. V.K. Chopra, learned CGC; Mr. G. Sarma, learned standing counsel for the FT and Border matters; Mr. A.I. Ali, learned standing counsel for the ECI; and Mr. P. Sarmah, learned Additional Senior Govt. Advocate for the State respondent.

2. The prayer in this interlocutory application is for correcting a typographical error that has crept in paragraph 3 of the order dated 16.09.2026, passed by this Court in WP(C) 5773/2023, by correcting the Case No. as "L.F.T. Case No. 669(D)/11 of Dist. No. 217".

3. On perusal of the copy of the writ petition, it appears that in paragraph 17 of the writ petition, reference was made by the petitioner to "L.F.T. Case No. 660(D)/11”. Therefore, it is the error which appeared in the drafting of the writ petition, which was reflected in paragraph 3 of the order dated 16.09.2026.

4. Accordingly, on a query of the Court, the learned counsel for the applicants seeks leave of the Court to withdraw this interlocutory application and to file a fresh application with a prayer to allow amendment to the statements made in paragraph 17 of the connected WP(C) 5773/2023 and consequential amendment of the order dated 16.09.2026.

5. The interlocutory application stands dismissed on withdrawn with liberty as prayed for.
