ORDER

Date : 12.10.2026

Heard Mr. D. Das, learned Counsel for the petitioner and Mr. DP Goswami, learned Additional Public Prosecutor for the State.

2. By this application, the petitioner has prayed for pre arrest bail in connection with Sivsagar PS Case No. 192/2026 registered under Section 108 of

BNS, 2023. The FIR in connection with which the petitioner apprehends arrest was lodged on 04.09.2026 by the sister of the deceased stating inter alia that the petitioner and her family members badly assaulted her brother resulting in injuries and that after the said assault, the mother of the victim had made a complaint before the Police and that a heated altercation had taken place between the victim and the petitioner’s side after which the victim was picked up and was made to sign blank pages. It was also stated that on 03.09.2026, the victim ate pitha from his mother and went to his room upstairs and that on the next day morning, his body was found hanging from the ceiling fan.

3. The learned Counsel for the petitioner submits that the story narrated in the FIR is a concocted story and that the petitioner was harassed by the victim's family for money and that many cases were lodged against the victim.

4. On the other hand, Mr. DP Goswami, learned Additional Public Prosecutor for the State on perusal of the Case Diary submits that there are materials against the petitioner regarding the offence made in the FIR.

5. It is also seen that the petitioner was enlarged on interim pre arrest bail by order dated 23.09.2026 on the ground that she should go and appear before the Investigating Officer and should cooperate with the investigation and Mr. DP Goswami, learned Additional Public Prosecutor for the State on perusal of the Case Diary also submits that the petitioner had appeared and her statement was recorded by the Police Officer.

6. It is as such seen that she is cooperating with the investigation and accordingly, this Court deems it fit to make the order dated 23.09.2026 absolute with the condition that the petitioner should follow the directions and conditions already mentioned in the said interim order without fail.

7. Petition is disposed of.
