ORDER

Date : 12.10.2026

Heard Mr. R. Bora, learned Counsel for the petitioner and Mr. DP Goswami, learned Additional Public Prosecutor for the State.

2. By this application, the petitioner has prayed for pre arrest bail in connection with PRC Case No. 127/2026 registered under Section 127(2)/115(2)/118(1)/3(5)

of BNS, 2023. The FIR in connection with which the petitioner is apprehending arrest was lodged by the victim stating inter alia that over an issue regarding a debate in Social Media with regard to a football match, two other accused persons mentioned in the FIR had called him to the market and when he reached, the said person dragged him inside the vehicle and took him to an office. It was further stated that the petitioner assaulted the informant with a bamboo pole.

3. The learned Counsel for the petitioner submits that the petitioner along with other accused persons were allowed interim pre arrest bail and during the pendency of the said application, charge sheet was submitted and in that charge sheet, the other accused persons were charged with bailable offence and the petitioner was charged with bailable offence along with one non-bailable offence and as such, the petitioner has filed his application for pre arrest bail.

4. On the other hand, Mr. DP Goswami, learned Additional Public Prosecutor for the State submits that the assault was made only by the petitioner as could be seen from the first information report as well as the charge sheet.

5. Upon considerations of the submissions made by the learned Counsels for the parties, more so in view of the report of the Medical Officer that the complainant had received simple injuries and also due to the fact that apart from the petitioner there were other persons present when the informant was assaulted, this Court deems it fit to enlarge the petitioner on pre arrest bail on furnishing of bail bond of Rs. 20,000/- with one local surety of the like amount to the satisfaction of the Arresting Authority under the following conditions:

i) the petitioner is directed to appear before the Court within 15 days without fail and should appear before the Court as and when called for.

ii) the petitioner will not hamper, tamper with the evidence, neither influence the witnesses connected with the case.

iii) the petitioner will not leave the place of jurisdiction without the permission of the Arresting Authority.

6. Petition is disposed of.
