Heard Mr. M. Ali, learned counsel for the accused applicants. Also heard Ms.

A. Begum, learned Additional Public Prosecutor appearing for the State.

2. This is an application filed under Section 483 of the BNSS, 2023 praying for grant of bail to the accused applicants namely 1. Asadul Alom and 2. Dipjyoti Chamuah, in connection with Bongaigaon P.S. Case No.218/2026 under Sections 308(2)/351(2)/356(2)/61(2) of BNS.

3. An FIR was lodged on 21.09.2026, by the informant namely, Kalua Devi before the Officer-in-Charge of Bongaigaon Police Station alleging inter alia that on 16.09.2026 at about 1 am, while some railway passengers were taking meal in her hotel situated at China Market, four passengers started to drink wine brought with them and she objected to it.

4. It is alleged that she has received call through whatsapp from mobile number 9864020900, whereby Rs.1,00,000/- was demanded from her and she threatened that otherwise, the video clip would be made viral. Thereafter, at around 2.06 pm, she received another phone call from mobile No.6001630993 belonging to accused No.1, who informed her that they would come to collect the money at 4.00 pm on the same day. Getting such threat, she intimated the local people and they waited for the accused no,1 to come. Accordingly, the accused No.1 and 2 came there to collect the money and the local people apprehended them and handed them over to the police as the police was informed earlier.

5. On receipt of the FIR, police registered Bongaigaon P.S. Case No.218/2026 under the aforementioned sections.

6. The learned counsel appearing for the accused applicants submits that they are not involved in any kind of activities that have been alleged in the FIR, in fact, they went to the place, on instruction of the owner of the local news channel and they were not aware of anything about demand of any money and therefore, prays that the accused applicants should be granted bail.

7. Case diary has been received and the same is perused.

8. The learned APP, on the other hand opposes the prayer for bail stating that sufficient incriminating materials are against the accused applicants in the case diary.

9. Taking into consideration the entire facts and circumstances of the case and the materials available in the case diary, this Court is not inclined to grant bail at this stage. Accordingly, the bail application stands dismissed.
