under

Sections

61(2)/318(4)/319(2)/308(7)/317(4)/ 351(3)/351(3)/111/3(5)/3(6)/3(9) of the BNS, 2023.

3. An FIR was lodged on 05.09.2026 by LNK (DSB) Jacky Modok of Nilambazar Police Station before the Officer-in-Charge of Nilambazar Police Station, alleging that certain persons are involved in collecting money by luring innocent victims with promises of settling their disputes. It was further alleged that they illegally collected money by threatening and coercing the victims with the prospect of cases being filed against them, thereby extorting money by impersonating authorised officials or advocates dealing with such cases.

4. On receipt of the FIR, the police registered Nilambazar P.S. Case No. 91/2026 under the aforementioned sections.

5. Mr. Ahmed, learned counsel for the accused applicant, submits that the accused applicant is innocent and the allegations made in the FIR are vague. He further submits that cases involving similar allegations have been registered at various police stations and that, in similar circumstances, a coordinate Bench of this Court has granted bail to the accused persons. He, therefore, prays for grant of bail to the accused applicant, who has been in custody since 07.09.2026.

6. Case Diary in the instant case has not yet been received.

7. Mr. Goswami, learned Additional Public Prosecutor for the State, opposes the prayer for bail and submits that the Case Diary should be perused.

8. Upon consideration of the submissions advanced by the learned counsel for the parties, the allegations made in the FIR and the period of detention undergone by the accused applicant, this Court is of the considered opinion that further detention of the accused applicant is not warranted at this stage.

9. Accordingly, it is directed that the accused applicant shall be released forthwith from judicial custody upon furnishing a bail bond of Rs. 30,000/- with one surety of a like amount to the satisfaction of the learned Chief Judicial Magistrate, Sribhumi, Assam, subject to the condition that the accused applicant shall appear before and cooperate with the Investigating Officer and make himself available for investigation as and when called for.

10. In terms of the aforesaid, the bail application stands disposed of.
