ORDER

Date : 09-10-2026 Heard Mr. M. H. Ahmed, learned counsel for the applicant. By filing this application, the applicant has prayed for impleadment of (i) Syedain Abbasi, Additional Chief Secretary to the Government of Assam, Irrigation Department, & (ii) Dhrubajyoti Roy Choudhury, Secretary to the Government of Assam, Irrigation Department, as respondent Nos. 7 & 8 in the connected contempt petition, being Cont. Cas(C) No. 239/2026. The applicant has filed the aforesaid contempt petition alleging violation of the judgment and order dated 28.11.2025, passed by this Court in WP(C) No. 6195/2025. It is submitted that during the pendency of the contempt petition, the earlier incumbents, namely, Shri Kailash Chand Samaria and Shri Adil Khan, who were arrayed as respondent Nos. 1 & 2, respectively, have been transferred and in their places, the opposite parties sought to be impleaded have been posted as Additional Chief Secretary and Secretary to the Government of Assam, Irrigation Department, respectively. Having considered that the opposite parties sought to be impleaded are presently holding the posts of Additional Chief Secretary and Secretary to the Government of Assam, Irrigation Department, I deem it appropriate to allow the present interlocutory application as the parties sought to be impleaded appears to be the necessary parties in the connected contempt petition. Accordingly, (i) Syedain Abbasi, Additional Chief Secretary to the Government of Assam, Irrigation Department, & (ii) Dhrubajyoti Roy Choudhury, Secretary to the Government of Assam, Irrigation Department, are allowed to be impleaded as respondent Nos. 7 & 8, respectively, in the connected contempt petition, being Cont. Cas(C) No. 239/2026. The interlocutory application stands allowed and disposed of.
