Heard Ms. F. Hussain, learned counsel appearing for the accused applicants and Ms. A. Begum, learned Additional Public Prosecutor for the State.

2. This is an application under Section 483 of the BNSS, 2023, praying for grant of bail to the accused applicants, who were arrested on 17.07.2026, in connection with Gossaigaon P.S. Case No. 155/2026 under Sections 61(2)/111/310(4) of the BNS, 2023 read with Sections 25(1)(a)/35 of the Arms Act.

3. The gist of the case is that on 17.07.2026, the informant, SI(P) Saddam Hussain of Gossaigaon, lodged an FIR before the Officer-in-Charge, Gossaigaon Police Station, stating, inter alia, that on 16.07.2026, information was received at Gossaigaon Police Station that three suspected armed persons had been apprehended by the villagers of Ballamguri under Gossaigaon Police Station; that upon reaching the spot, the police found three persons surrounded by locals and in an injured condition, allegedly having been assaulted on suspicion of being members of a dacoity gang; that during a search of the area, one suspected handmade firearm containing one live round, one charging cable and one blue shoulder bag were recovered and seized; that the arrested persons were all residents of Basti District, Uttar Pradesh and disclosed that another associate had fled from the spot; that they revealed that they had come to the Ballamguri area with the assistance of certain local associates and had planned to commit dacoities in the nearby areas.

4. On receipt of the FIR, the police registered the Gossaigaon P.S. Case No. 155/2026 under the aforementioned sections.

5. The accused applicants had earlier approached this Court by filing Bail Application No. 2742 of 2026, however, the same was rejected on 28.09.2026.

6. Ms. Hussain, learned counsel for the accused applicants, submits that the accused applicants have been behind bars for the last 85 (eighty-five) days and that their further custodial interrogation may not be required at this stage.

7. Ms. Begum, learned Additional Public Prosecutor, opposes the prayer for bail at this stage and submits that the case diary may be called for.

8. Taking into consideration the fact that the accused applicants have been behind bars for the last 85 (eighty-five) days, this Court is of the considered opinion that the accused applicants in the instant case should be granted bail.

9. Accordingly, it is directed that the accused applicants shall be released from jail forthwith on furnishing bail bonds of Rs. 30,000/- (Rupees Thirty Thousand) each, with two sureties for the like amount, one of whom shall be a local resident, to the satisfaction of the learned SDJM, Gossaigaon, subject to the following conditions:

(i) that the accused applicants shall cooperate with the investigation and make themselves available as and when called for;

(ii) that the accused applicants shall not tamper with the evidence or hamper the investigation;

(iii) that the accused applicants shall furnish their contact details, including photocopies of their Aadhaar cards or PAN cards, mobile numbers, driving licenses and other relevant contact details, before the learned SDJM, Gossaigaon.

10. With the above directions, the instant bail application stands disposed of.
