ORDER

Date : 09/10/2026

1. Heard learned counsel for the parties.

2. The petitioner is serving as CT/GD and presently posted at 41 Bn. SSB, Ranidanga, West Bengal. While the petitioner was posted at 31 Bn. SSB, Maliajuri, Gossaigaon, the respondent no. 6 filed an application before the employer of the petitioner for incorporation of her name in the service record, claiming herself to be the wife of the petitioner. The petitioner denies such marital status, rather, claims that the respondent no. 6 is a married woman with a 10 year child and he had only acquaintance through social media with her. In the meantime, a departmental enquiry was also initiated against petitioner for alleged plural marriage, which is pending before the employer as on date. The petitioner challenged such incorporation of the name of respondent no. 6 in his service record as well as the departmental enquiry.

3. During the pendency of this petition, the petitioner and respondent no. 6 have amicably settled their dispute and entered into an agreement, wherein respondent no. 6 has declared her intention by swearing an affidavit before the Notary at Tezpur, which goes to show that she had taken back her statement regarding her marriage with the petitioner and that they have reached an out of court settlement. She also consented in the affidavit to remove her name from the service book, nomination file and official record of the petitioner (REGT no. 131053099 CT/GD) and to request the employer to drop/close and exonerate the petitioner from the on-going departmental enquiries. It is also on record in the affidavit filed by the petitioner that similar prayer was communicated by the respondent no. 6 to the employer of the petitioner.

4. In view of the aforesaid, the present writ petition stands disposed of providing that the respondent employer shall take due note of the aforesaid development of amicable settlement and the request of the respondent no. 6 and proceed in accordance with law.
