ORDER

Date : 09.10.2026

Heard Mr. S.H. Sikdar, learned counsel appearing for the accused-applicant. Also heard Mr. M.P. Goswami, learned Addl. P.P., representing the State respondent.

2. This is an application under Section 483 of the BNSS, 2023, praying for granting bail to the accused-applicant in connection with Baihata Chariali Police

Station Case No. 175/2026, registered under Sections 304(2)/309(4)/3(5) of the BNS, 2023.

3. An FIR was lodged on 04.08.2026 by the informant before the Officer-in- Charge, Baihata Police Station, to the effect that the informant and his son, after withdrawing a cash amount of Rs. 4 lakhs from SBI Baihata Chariali Branch by a motorcycle, their motorcycle was knocked down by two unknown persons, and thereafter they have snatched the bag containing the Rs. 4 lakhs from the informant's hand and fled away.

4. On receipt of the FIR, police registered Baihata Chariali Police Station Case No. 175/2026, under the aforementioned sections.

5. The learned counsel appearing for the accused-applicant submits that the accused-applicant has been arrested only on the basis of suspicion, and some CCTV footage was found wherein the accused-applicant was found to be near the place where the occurrence had taken place. He submits that taking into account that the accused-applicant has already spent 57 days behind the bars, he should be granted bail.

6. Mr. M.P. Goswami, learned Addl. PP, on the other hand, opposes the prayer of the bail.

7. The Case Diary in the instant case has been received and the same is perused.

8. Taking into account the prima facie materials available about the accused- applicant's involvement in the instant case, this Court is not inclined to grant any relief to the accused-applicant at this stage.

9. Accordingly, the instant bail application stands rejected.
