ORDER

Date : 09.10.2026

Heard Mr. T. R. Sarma, the learned counsel appearing on behalf of the Petitioner and Mr. D. Doley, the learned CGC appearing on behalf of the Respondent Nos. 1 and 2.

2. The Petitioner herein claims that he was born on 11.01.1958 however, in the passport, which was earlier issued to the Petitioner being the Passport No. A0810227, the date of birth was mentioned as 11.01.1960. The Petitioner thereupon filed an application for renewal of the passport which expired on 29.10.2006.

3. The Petitioner was asked to provide a Birth Certificate vide the communication dated 06.05.2025. It is the case of the Petitioner that the Petitioner does not have the Birth Certificate. However, he has various other documents such as the PAN Card, Voter's ID as well as the Driving License. Being aggrieved, the Petitioner has approached this Court by filing the present writ petition on 28.09.2026.

4. From the materials on record, there is nothing to show that the Petitioner had represented before the authority asking that in view of the Passport (Amendment) Rules, 2025, what are the other documents which the Petitioner can submit in lieu of the Birth Certificate.

5. Considering the above, as the Petitioner has not approached the Respondent Authorities in that regard, this Court is not inclined to entertain the instant writ petition, for which the writ petition stands dismissed.

6. Before parting with the record, this Court however observes that the dismissal of the instant writ petition shall not preclude or prejudice the Petitioner to submit a representation before the Regional Passport Officer, Guwahati drawing the attention to the Passport (Amendment) Rules, 2025 along with the documents mentioned therein.
