ORDER

Date : 08-10-2026

Heard Mr. S. Nag, learned counsel appearing for the accused applicant and Mr. M. P. Goswami, learned Additional Public Prosecutor for the State.

2. This is an application under Section 483 of the BNSS, 2023, praying for grant of bail to the accused applicant, who was arrested on 05.09.2026, in connection with Ramkrishna Nagar P.S. Case No. 85/2026 under Sections 61(2)/318(4)/319(2)/308(7)/ 317(4)/351(2)/351(3)/111/3(5)/3(6)/3(8)/3(9) of the BNS, 2023.

3. The gist of the allegation involved in the instant case is that on 05.09.2026, pursuant to an FIR lodged by one DSB LNK-Amit Sharma of the District Special Branch at R.K. Nagar Police Station, alleging that certain individuals, without having any official sanction or recognised legal qualifications, were operating around the premises of R.K. Nagar Police Station, demanding money from members of the public visiting the police station, dictating informal compromises under the threat of false cases and impersonating authorised officials. It is alleged that the accused persons, acting in concert and pursuant to a conspiracy, projected themselves as advocates, legal personnel and police-authorised persons or intermediaries, giving unauthorised advice and abusing the victims to pay money by falsely claiming that criminal cases would be settled, altered, compromised or withdrawn after consideration. It is further alleged that these persons also threatened to lodge false cases against the victims under the POCSO Act, BNS and NDPS Act, thereby forcing them to enter into settlements and extorting money and property from one or both sides. It is alleged that the accused persons retained and shared the proceeds amongst themselves and habitually received and dealt with stolen property obtained through cheating, extortion, etc.

4. Mr. Nag, learned counsel for the accused applicant, submits that there is no specific allegation against the accused applicant in the FIR in the instant case and that the allegations are totally vague in nature. It is also submitted that, in similar cases, several co-accused have been granted bail by the Coordinate

Benches of this Court in various bail applications. In support of his submission that the Coordinate Benches of this Court have granted bail to several co- accused facing similar allegations, the learned counsel for the accused applicant has placed certain orders passed by the Coordinate Benches of this Court.

5. Mr. Goswami, learned Additional Public Prosecutor for the State, on the other hand, submits that there are several allegations which are of a serious nature and that the investigation in the instant case is yet to be completed. He, therefore, opposes the prayer for bail of the accused applicant at this stage.

6. The Case Diary in the instant case has been called for, however, the same has not yet been received.

7. I have heard the submissions advanced by the learned counsel appearing for the parties.

8. Taking into consideration the fact that, on similar allegations, similarly situated co-accuses have been granted bail, this Court is of the considered opinion that the accused applicant in the instant case should also be granted bail.

9. Accordingly, it is directed that the accused applicant shall be released from jail forthwith on furnishing a bail bond of Rs.50,000/- (Rupees Fifty Thousand) with one surety of the like amount to the satisfaction of the learned Chief Judicial Magistrate, Sribhumi, Assam, subject to the following conditions:

(i) The accused applicant shall cooperate with the investigation and make himself available as and when called for;

(ii) The accused applicant shall not tamper with the evidence or hamper the investigation.

10. With the above directions, the instant bail application stands disposed of. JUDGE Comparing Assistant
