ORDER

Date : 08.10.2026

Heard Mr. H.R.A. Choudhury, learned Senior Counsel, assisted by Mr. A. Ahmed, learned counsel appearing for the accused-applicant. Also heard Mr. M.P. Goswami, learned Addl. P.P., representing the State respondent.

2. This is an application filed under Section 483 of the BNSS, 2023, praying for granting bail to the accused-applicant in connection with Bokajan P.S. Case No. 41/2026, registered under Sections 112/308 (6)/308 (7)/317 (4)/318 (4)/319 (2)/351(2) /351(3)/62(2)/3(5)/3(8) and 3(9) of the BNS, 2023.

3. An FIR was lodged by one Sub-Inspector of Police of Bokajan Police Station on 05.09.2026 against the accused-applicant and another co-accused, and some other persons, alleging, inter alia, that the accused-applicant, presenting herself as an influential person and having connections with police officers, demanded money to settle criminal matters between the complainant and the accused persons. It is alleged that if the victims were not willing to give money for settlement, she threatened them to take legal action against them. It is also alleged that the accused-applicant demanded and collected money from members of the public on the pretext of settling criminal cases and for securing favorable action in such cases.

4. On the basis of the FIR, the police registered Bokajan Police Station Case No. 41/2026, under the aforementioned sections.

5. The learned Senior Counsel appearing for the accused-applicant submits that, in fact, the accused-applicant is a respected lady of the locality, involved in various human rights activities, and she is not at all involved in the alleged offense in the FIR. He submits that the accused-applicant has been in judicial custody for the last 33 days, and further custodial detention of the accused-applicant may not be required in the instant case. He further submits that a co-accused in the instant case has already been granted bail by the learned Sessions Judge, Karbi Anglong. In view of the above, he submits that the accused-applicant should be granted bail at this stage.

6. The Case Diary in the instant case has been received and perused.

7. The learned Addl. PP, on the other hand, opposes the prayer for bail of the accused-applicant, submitting that there are incriminating materials available in the Case Diary against the accused-applicant.

8. This Court has considered the submissions made by the learned counsel for the parties.

9. Taking into account the fact that the accused-applicant is a lady who has already been in judicial custody for the last 33 days, this Court is of the opinion that further custodial detention of the accused-applicant may not be required in the instant case. Accordingly, it is directed that the accused-applicant shall be released on bail on her furnishing a personal bond of Rs. 50,000/- (Fifty Thousand) with one local surety of the like amount to the satisfaction of the learned SDJM, Bokajan, Karbi Anglong, subject to the following conditions: -

(i) that the accused-applicant shall cooperate with the investigation;

(ii) that the accused-applicant shall not tamper with the evidence or hamper the investigation in any manner;

(iii) that the accused-applicant shall not indulge in any kind of activities as alleged in the FIR.

10. In terms of the aforesaid direction, the instant bail application stands disposed of.

11. Case Diary to be sent back.
