ORDER

Date : 08.10.2026

Heard Mr. R. Ghosh, learned counsel appearing for the accused-applicant. Also heard Mr. M.P. Goswami, learned Addl. P.P., representing the State respondent.

2. This is an application under Section 483 of the BNSS, 2023, praying for granting bail to the accused-applicant in connection with Basistha Police Station Case No. 365/2026, registered under Section 140(3) of the BNS, 2023.

3. An FIR was lodged on 20.09.2026 by one Sandamita Das, alleging that on 19.09.2026, at around 2.00 PM, her daughter, aged 14 years, was coming from Kahilipara towards Basistha Chariali. However, since she did not return home, the informant suspected that she might have been kidnapped by an unknown person from Basistha Chariali. During investigation, it was later on found out that the girl was with one accused person, namely, Rabijit Sharma in a homestay, namely, Dayasagar Go Holiday Homestay.

4. The learned counsel appearing for the accused-applicant submits that the accused-applicant is the manager of the homestay wherein the girl was found. He submits that in the instant case, police had sought for remand of the accused- applicant only for three (3) days. However, the accused-applicant is still in custody for the last 17 days. He further submits that further custodial detention of the accused-applicant may not be required in the instant case as the victim as well as the accused person have been found out by the police.

5. The Case Diary in the instant case has been received and the same is perused.

6. The learned Addl. PP, on the other hand, opposes the prayer of bail application of the accused-applicant.

7. Taking into account of the fact that the accused-applicant is the manager of the homestay and the victim girl as well as the accused person has already been recovered by the police, further detention of the accused-applicant may not be required in this case. Accordingly, it is directed that the accused-applicant shall be released on bail on his furnishing a bail bond of Rs. 30,000/- (Thirty Thousand) with one local surety of the like sum to the satisfaction of the court of learned CJM,

Kamrup (Metro), subject to the condition that the accused-applicant shall cooperate with the investigation and make himself available as and when called by the Investigating Officer and shall not hamper or tamper with the investigation.

8. In terms of the above direction, the instant bail application stands disposed of.
