ORDER

Date : 07.10.2026 Heard Mr. A. K. Azad, the learned counsel for the accused applicant. Also heard Ms. A. Begum, the learned Addl. Public Prosecutor for the State.

2. This is an application filed under Section 483 of the BNSS, 2023, praying for granting bail to the accused-applicant, namely, Sri Ranjit Misra @ Kante, in connection with Belsor P.S. Case No. 41/2026, registered under Section 22(b) of the NDPS Act, 1985.

3. The facts of the case is that on 10.05.2026 at about 7.54 p.m., information was received from a reliable source by the Office-in-Charge of Nalbari Police Station that one person, namely, Rajib Ali, has been selling suspected NDPS substances at Chamata Auto Stand Market. Pursuant thereto, GDE No. 10 dated 10.05.2026 was recorded and a police party went to the place and after apprehending the accused person, namely, Rajib Ali and on search being made, police recovered 65 capsules containing Tramadol Hydrochloride, Dicyclomine Hydrochloride and Acetaminophen along with a cash amount of Rs.21,060/-. On receipt of the FIR, police registered Belsor P.S. Case No. 41/2026 under the aforementioned section.

4. The counsel for the accused applicant submits that the accused applicant is behind bars for 109 days and the quantity recovered from the accused applicant is of intermediate quantity. He further submits that the accused applicant has been arrested only on suspicion and on the basis of the statement made by the co-accused, therefore, the accused applicant should be granted bail.

5. On the other hand, the learned Addl. Public Prosecutor and the counsel for the respondent No. 2 oppose the prayer of bail.

6. The case diary in the instant case has been received and the same is perused.

7. Taking into account the materials available in the TCR, specifically the statements made by the witnesses and having prima facie found sufficient materials against the accused applicant, this Court is not inclined to grant any relief to the accused applicant. Accordingly, the prayer for bail stands rejected at this stage.
