ORDER

07.10.2026

1. Heard Ms. G. Borah, learned counsel for the petitioner. Also heard Mr. J. Payeng, learned counsel for the respondent Nos. 3 and 7; Mr. A. I. Ali, learned Standing Counsel for the Election Commission of India representing the respondent Nos. 2, 4, 5 and 6.

2. The petitioner claims that her name appeared in the Voter List of 2019 at Sl. No. 883 against House No. 187 of Village- Seconee Borhula, Mouza- Satial, PS- Jakhalabandha in the District- Nagaon (Assam), however, her name was marked “D” in the said Voter List.

3. Being aggrieved, the petitioner approached this Court by filing a writ petition being WP(C) No. 5951/2019, which was disposed of by a Coordinate Bench under its order dated 26.02.2020 directing the petitioner to appear before the Superintendent of Police (Border), Nagaon and on such appearance and furnishing of representation, appropriate steps were directed to be taken in this regard. However, alleging that even after the appearance of the petitioner, the Superintendent of Police (Border), Nagaon, has not carried out the aforesaid direction, the present writ petition is filed.

4. Mr. J. Payeng, learned counsel representing the State respondent submits that he has instruction to submit that though there was an inadvertent delay on the part of the Superintendent of Police (Border), Nagaon, however, the entire process will be completed in terms of this Court’s earlier order dated 26.02.2020 (supra) within a period of 30 days as directed earlier.

5. In view of the aforesaid submission and as agreed to by the learned counsel for the petitioner, this writ petition stands disposed of by directing the Superintendent of Police (Border), Nagaon, to carry out the entire exercise as directed by this Court under its order dated 26.02.2020 (supra) within a period of 30 days from the receipt of a certified copy of this order to be furnished by the petitioner.
