ORDER

Date : 07.10.2026

Heard learned counsel Ms. L. Sharma for the Insurance Company and learned counsel Mr. A. Bhattacharyya for the respondents No. 1, 2 and 3.

2. The applicant/appellant is aggrieved by the Judgment and Award dated 10.02.2025 passed by the learned Member, MACT, Goalpara in connection with MAC Case No. 166/2020.

3. The Insurance Company is aggrieved by the quantum of award as the deceased was a retired Government employee. The learned counsel for the

Insurance Company has prayed to stay the operation of the Judgment and Award dated 10.02.2025 passed by the learned Member, MACT, Goalpara in connection with MAC Case No. 166/2020.

4. I have considered the submissions at the bar. It appears that the operation of the Judgment and Award dated 10.02.2025 passed by the learned Member, MACT, Goalpara in connection with MAC Case No. 166/2020 may be stayed. Thereby, the operation of the Judgment and Award dated 10.02.2025 passed by the learned Member, MACT, Goalpara in connection with MAC Case No. 166/2020 is stayed until further orders, subject to the condition that the Insurance Company deposits 30% of the awarded amount before the Registry of this Court within six weeks from today and thereafter, the respondent No. 1 may be allowed to withdraw the amount deposited before the Registry of this Court, on being identified by the Registry and on execution of an indemnity bond.

5. In terms of the above observation, this interlocutory application stands disposed of.
