ORDER

Date : 07-10-2026

1. Heard Mr. A. Alim Sk., the learned counsel appearing for the accused- applicant. Also heard Mr. M.P. Goswami, the learned Addl. P.P, Assam appearing for the State.

2. This is an application filed under Section 483 of the BNSS, 2023, praying for granting bail to the accused-applicant, namely Mirajul Sheikh in connection with Bilasipara P.S. Case No.272/2026 registered under Sections 21(b)/29 of the NDPS Act.

3. The allegation made in the FIR dated 01.08.2026 is that a total quantity of 28 grams of heroin has been recovered from the possession of the accused-applicant.

4. After completion of the investigation, police filed the charge-sheet on 08.09.2026. The accused-applicant was arrested on 04.08.2026 and since then he is behind bars.

5. The learned counsel appearing for the accused-applicant submits that though the charge-sheet has been filed and 12.10.2026 has been fixed for appearance, since the accused-applicant is behind the bars for 68 days, the accused-applicant should be granted bail at this stage, as the quantity seized is of intermediate quantity.

6. The scanned copy of TCR in the instant case is received and the same has been perused.

7. The learned Addl. P.P has opposed the prayer for bail of the accused- applicant.

8. Taking into account the fact that charge-sheet in the instant case has been filed and 12.10.2026 has already been fixed for appearance, this Court does not find any ground to grant bail to the accused-applicant at this stage.

9. Accordingly, the instant bail application is rejected at this stage. JUDGE Comparing Assistant
