ORDER

Date : 06.10.2026

1. Heard Ms. F. Intaz, learned counsel for the petitioner. Also heard Mr. Bhaskar Sharma, learned Additional Public Prosecutor for the State of Assam.

2. This is an application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, whereby the petitioner, Jahangir Ali, who was arrested in connection with Nagarbera P.S. Case No.61/2026, under Section 85/82(1)/318(2)/316(2)/3(5) of the BNS, has prayed for releasing him on bail.

3. The informant herein is his lawful married wife. She has alleged that, after Page No.# 2/2 giving birth to twin daughters, the petitioner started physically harassing her. She further alleged that she subsequently came to know that the petitioner had developed a relationship with another woman. When she brought the said fact to the notice of the other members of the family, the petitioner allegedly subjected her to further physical harassment and compelled her to leave her matrimonial home.

4. The petitioner has spent 28 days in judicial custody.

5. I have considered the submission made by the learned counsel for both sides.

6. This is a dispute between the husband and wife, therefore this Court is of the opinion that the period undergone by the petitioner deserves to be taken up as one of the ground for releasing him on bail.

7. Therefore, his bail application is allowed.

8. The petitioner, Jahangir Ali, who was arrested in connection with Nagarbera P.S. Case No.61/2026 shall be released on bail of Rs.25,000/- with a surety of like amount to the satisfaction of the learned Judicial Magistrate First Class, Boko.
