ORDER

06.10.2026

1. Heard Mr. P.B. Bordoloi, learned legal aid counsel appearing for the Page No.# 2/2 appellant. Also heard Mr. D.P. Goswami, learned APP appearing for the State of Assam and Mr. U. Choudhury, learned Amicus Curiae appearing for the respondent No.2.

2. By order dated 14.09.2026, this Court had directed the Registry to obtain information from the Superintendent of District Jail, Majuli as to whether the applicant had already served out the sentence imposed upon him. The said order was passed in view of the fact that the judgment was delivered on 27.07.2023 and the order of sentence was passed on 28.07.2023 whereby the appellant was sentenced to undergo imprisonment for a period of 3 years along with a fine and a default stipulation. When the matter was taken up, the learned counsel appearing for all the parties submitted that the period of 3 years had already elapsed and accordingly this Court deemed it appropriate to call for instructions in that regard.

3. Today, when the matter is taken up a report from the Superintendent of District Jail, Majuli has been placed before this Court wherein it has been stated that the appellant, namely, Shri Krishna Das was released from jail on 25.02.2026 upon completion of the sentence imposed upon him pursuant to the aforesaid judgment.

4. The appeal is accordingly closed.
