ORDER
Date : 05-10-2026 Learned counsel Mr. R.C. Paul is present for the Insurer and learned counsel Mr. H. Gogoi is present on behalf of learned counsel Mr. S. Das for the caveators and claimants.
2. It is submitted that there was a delay of 93 (Ninety Three) days in filing the connected appeal.
3. The applicant company received the copy of the judgment and award dated 29.01.2026 passed by the Commissioner, Employees’ Compensation, Kamrup (M), Guwahati, in W.C. Case No. 08/2017 in the month of February and enquired into the matter to trace out the records of the case in the office of the applicant company, but could not trace out the records. Thereafter, the competent authority of the applicant company on 16.02.2026 engaged a penal advocate of the applicant company to collect the entire case record from the office of the Commissioner, Employees’ Compensation, Kamrup (M), Guwahati and he applied for certified copies of the case record in the said office on 24.02.2026. On 07.05.2026 and 12.05.2026, the case records were received and submitted to the office of the applicant company.
4. On receipt of the legal opinion from the penal advocate, the authorities have gone through the entire aspect of the matter and narrated the same to the Commissioner for his advice to prefer an appeal. This led to the delay.
5. Learned counsel Mr. H. Gogoi for the claimants has raised no objection against the delay.
6. Sufficient reasons have also been shown. It appears that the delay may be condoned. Thereby, the delay of 93 (Ninety Three) days is condoned.
7. Registry to register the connected appeal.
8. In terms of the above observation, this interlocutory application stands disposed of. JUDGE Comparing Assistant
