THE GAUHATI HIGH COURT (HIGH COURT OF ASSAM, NAGALAND, MIZORAM AND ARUNACHAL PRADESH) Case No. : AB/2295/2026 AKBAR @ AKBOR ALI SON OF KASER ALI, RESIDENT OF MAHAMAYARCHAR, POLICE STATION AND DISTRICT- SOUTH SALMARA, ASSAM. VERSUS THE STATE OF ASSAM REPRESENTED BY THE PUBLIC PROSECUTOR, ASSAM. Advocate for the Petitioner : MR A TALUKDAR, S BEGUM,MR. B J TALUKDAR,MR. DITUL DAS Advocate for the Respondent : PP, ASSAM, BEFORE HONOURABLE MR. JUSTICE PARTHIVJYOTI SAIKIA 05.10.2026

Heard Mr. Ditul Das, learned counsel appearing for the petitioner. Also heard Mr. K K Das, learned Additional Public Prosecutor, Assam. This application has been filed under Section 482 of the BNSS, 2023 praying for granting pre-arrest bail by the petitioner, namely, Akbar @ Akbor Ali, in connection with Special (N) Case No. 70/2025, pending in the Court of the learned Special Judge, South Salmara at Mankachar. The petitioner has been shown as an absconder in the Charge Sheet. It is submitted that although the petitioner intends to appear before the trial Court now, he apprehends Page No.# 2/2 that if he appears before the trial Court at his own, he may be remanded to custody. Further, the petitioner has submitted that he is in facing the trial. I have considered the submissions made by the learned counsel for both sides. Mr. Das has expressed his objection before this Court against the prayer of the petitioner. Having heard the learned counsel for both the sides, this Court is of the opinion that an opportunity should be given to the petitioner to contest the trial, as he is interested. In view of the above, the petitioner Akbar @ Akbor Ali is directed to appear before the learned Special Judge, South Salmara at Mankachar within 7 (seven) days from today in connection with Special (N) Case No. 70/2025. On his appearance, the learned Special Judge, South Salmara at Mankachar shall release the petitioner Akbar @ Akbor Ali on bail of Rs.50,000/- with one surety of like amount to the satisfaction of the learned Special Judge, South Salmara at Mankachar. With the above, the bail application is disposed of.
