BEFORE

HONOURABLE MR. JUSTICE SANJAY KUMAR MEDHI

ORDER

30.09.2026 Heard Shri M. Dutta, learned Senior Counsel assisted by Shri A. K. Hannan, learned counsel for the petitioner. Also heard Ms. D. Das Barman, learned State Counsel for the respondents. The petitioner is aggrieved by a notification dated 02.09.2026 whereby his services as Special Public Prosecutor, POCSO at the Hailakandi district has been terminated. The petitioner was appointed in the said capacity on 03.10.2023. After some deliberation, the learned Senior Counsel upon instructions submits that he may be allowed to withdraw the challenge. However, an anxiety has been expressed regarding any stigma which may be attached by the impugned order. On a bare perusal of the impugned notification, it clearly appears that the termination is simpliciter which should not be construed to be stigmatic for any future purpose. With those observations, the writ petition is closed on withdrawal.
