ORDER
Date : 30.09.2026 Heard Mr. D. Borah, learned counsel for the petitioner; Ms. N. Bordoloi, learned Standing Counsel, Revenue Department for the respondent no. 1; and Mr. N. Das, learned Junior Government Advocate, Assam for the respondent nos. 2, 3 & 4.
2. The petitioner no. 1 Satra is represented by the petitioner no. 2. It is stated that for allotment/settlement of a plot of land measuring 2 Bighas, covered by Dag no. 2031, at Village – Sualkuchi, Hajo Revenue Circle in favour of the petitioner no. 1 Satra, an application for Allotment Certificate was submitted on 02.04.2023. It is stated that the said plot of land was earlier allotted in favour of the respondent no. 5. An enquiry was undertaken to ascertain whether the said plot of land was under possession of the respondent no. 5 for last 3 [three] years or not. The petitioners have projected that as per an Enquiry Report submitted by the respondent no. 4 before the respondent no. 3 on 30.06.2026, it can be noticed that the purpose for which the land was earlier allotted to the respondent no. 5 was not effectuated, and the respondent no. 5 does not have physical possession over it. Thereafter, the respondent no. 3 initiated a proceeding in that connection and by a Notice dated 18.08.2026, the respondent no. 3 asked the petitioner no. 2 and the respondent nos. 5 & 6 to appear before him to decide on the matter of allotment/settlement of said Government land under Dag no. 2031. It is stated that the petitioner no. 2 could not appear on the scheduled date of hearing, 21.08.2026. Therefore, he submitted an application on 24.08.2026 to re-fix the date of hearing. Having received no response after 24.08.2026, the petitioners are before this Court by the present writ petition.
3. Mr. Das, learned Junior Government Advocate appearing for the respondent nos. 2, 3 & 4, on receipt of instruction from the respondent no. 3 vide an Office Letter no. E-55896 LS- 11/2313/2023-KRS/ dated 28.09.2026, has submitted that the hearing in the matter has been re-fixed on 06.10.2026 and a notice in that connection has already been issued to the concerned parties.
4. Mr. Borah, learned counsel appearing for the petitioner having learnt that the date of hearing has been re-fixed on 06.10.2026 has submitted that the petitioner will appear in the hearing scheduled on 06.10.2026.
5. As the hearing is fixed on 06.10.2026, no further order is required to be passed in this writ petition. The writ petition is accordingly closed.
6. The copy of the Office Letter no. E-55896 LS-11/2313/2023-KRS/ dated 28.09.2026 is kept with the case record.
