ORDER
Date : 29.09.2026 (K.R. Surana, J) Heard Mr. R.P. Kakoti, learned senior counsel, assisted by Mr. S. Sutradhar, learned counsel for the appellant. Also heard Dr. A. Lal, learned counsel for the respondent.
2. This Court, upon hearing both sides, had passed an order to admit the appeal for hearing and the order was being dictated in connection with interlocutory application, being I.A.(Civil) No.3390/2026.
3. At this stage, the learned counsel for the respondent has submitted that as the sanction imposed against the respondent is to debar him from attending the academic session for July to November, 2026, and there would be no bar for the respondent to register in subsequent semester from January, 2027, the respondent would accept the sanctions without prejudice to his admission in the subsequent semester from January, 2027.
4. Accordingly, it is submitted that in view of the anticipation that once the writ appeal is admitted for hearing, it may not be heard early, he has given his consent to allow the writ appeal without prejudice to the right of the respondent to register himself in the subsequent semester from January, 2027.
5. In this regard, the learned senior counsel appearing for the appellants has no objection.
6. Consequently, on admission made by the learned counsel for the respondent and in view of his submissions that the decision in this appeal would not prejudice the right of the respondent to be admitted in the subsequent semester from January, 2027, this writ appeal stands allowed.
7. As there is an admission by the learned counsel for the respondent, on his prayer made, the Court does not deem it necessary to burden this order with the discussion and decision on merit, taking note of the fact that the respondent is more interested in pursuing his academic career.
8. Accordingly, this writ appeal stands allowed on admission by the learned counsel for the respondent. Consequently, the order dated 07.09.2026, passed by the learned Single Judge in WP(C) No. 3757/2026 is hereby set aside.
9. It is clarified that as this writ appeal is being disposed of taking into account the future career of the respondent, it is provided that this order and the disciplinary sanction against the respondent would not come in the way of the respondent to pursue his academic career from the session January, 2027.
