Heard Mr. Y. Sikdar, learned counsel for the accused and also heard Mr. M.P. Goswami, learned Additional Public Prosecutor, Assam, appearing for the State respondent.

2. This bail application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 is preferred by the accused, namely, Sirajul Ali, who has been languishing in jail hazot since 31.08.2026, in connection with Dharamtul P.S. Case No.51/2026 under Section 8(c)/21(b)/29 of the NDPS Act, 1985, for grant of bail.

3. The gist of the allegations in the FIR is recovery of suspected heroin from the premises of co-agent Rejia Begum and subsequently, it was revealed from her examination that she had procured the said contraband from the shop of the present petitioner and thereafter, he was arrested.

4. The case diary as called for has been received along with a bail objection.

5. The prosecution supporting the bail objection contends that investigation has revealed that the said Rejia Begum co-accused was indulging in peddling of narcotic drugs for a considerable time and that she used to source her supply from the present petitioner Sirajul Ali. It is submitted by the prosecution that the investigation is looking into the secondary linkages of Sirajul Ali regarding the trafficking of drugs by both the accused persons of this case and their other persons.

6. The IO has strongly objected to the grant of bail by the bail objection.

7. I have perused the contentions of the IO in the bail objection. The investigation is stated to be progressing at crucial stage.

8. In the given facts and circumstances, accepting the contentions of the IO and the prosecution, I am of the considered opinion that it might be prudent to refuse bail at this stage.

9. Accordingly, the instant bail petition stands rejected at this stage.

10. Send back the case diary. JUDGE Comparing Assistant
