ORDER

28.09.2026

Heard Ms. A. Gayan, learned counsel for the applicant and Mr. M.M. Zaman, learned counsel on behalf of Mr. S. Chamaria, learned counsel for the opposite party nos. 1, 2 & 3.

2. The instant interlocutory application is filed by the applicant for impleadment of the following authority :- Punjab National Bank, Narengi Tiniali Branch, Patharquary, VIP Road, Guwahati – 781171.

as a party-respondent no. 4 in the connected writ petition, W.P.[C] no. 4977/2019.

3. The applicant as the writ petitioner has preferred the connected writ petition to assail an action on the part of the respondent United Bank of India authorities in re-possessing a vehicle financed to the applicant-petitioner. It has been contended that the vehicle taken on loan by the petitioner from them had been forcefully repossessed in complete violation of the procedure prescribed in Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest [SARFAESI] Act, 2002.

4. In this application, it is averred that during the pendency of the writ petition, the United Bank of India had been merged with the Punjab National Bank and in view of such merger, it has become necessary to implead the afore-mentioned authority as party- respondent no. 4 in the connected writ petition for effective adjudication of the issues involved therein.

5. Mr. Zaman, learned counsel appearing for the opposite party nos. 1, 2 & 3 has admitted about the fact of merger of the United Bank of India with the Punjab National Bank.

6. In view of the projections made in the afore-stated manner, this Court is of the view that the afore-mentioned authorities is found to be a necessary party for adjudication of the issues involved in the connected writ petition. Therefore, the instant interlocutory application is allowed. JUDGE Comparing Assistant
