ORDER
Date : 28.09.2026 Heard Mr. T.R. Sarma, learned counsel for the petitioners and Ms. N. Bora, learned Standing Counsel, P&RD Department.
2. The petitioners claim to have been running a daily market on their private land and that though it is a private market over the patta land in the name of “Khalishabhita Daily Market”, the respondent/ Panchayat authorities are collecting revenue from the vendors and accordingly being aggrieved, the present petition has been filed.
3. On a pointed query to the learned counsel for the petitioners, whether the petitioners have obtained any prior approval from the concerned Panchayet authorities and the Government to run such market as required under Section 107 of the Assam Panchayat Act, 1994, it is submitted that such approval is not obtained. Accordingly, the learned counsel submits that the petitioners may be allowed to withdraw this writ petition and to approach the authorities to obtain required approval under the provisions of the Assam Panchayat Act, 1994.
4. Such prayer is not objected by the learned Standing Counsel, P&RD Department.
5. Accordingly, writ petition is dismissed on withdrawal with liberty as prayed for.
6. Interim order, if any, passed earlier stands vacated. JUDGE Comparing Assistant
