ORDER
23.09.2026
1. This application under Order 41 Rule 5 of the Code of Civil Procedure, 1908 has been filed praying for stay of the operation of the impugned judgment and order dated 28.10.2024 passed in MAC (Death) Case No. 56/2016 by the learned MACT, Morigaon.
2. In view of the fact that the accompanying MAC Appeal has been admitted by this Court, in interest of justice, the impugned judgment and award dated 28.10.2024 passed in MAC (Death) Case No. 56/2016 passed by the MACT, Morigaon is stayed during the pendency of the connected MAC Appeal No. 193/2026 subject to the condition that the appellant/applicant shall deposit 50% of the awarded amount before the Registry of this Court within a period of six weeks from the date of this order.
3. It is further directed that the Registry shall disburse the said deposited amount to the claimant/opposite party No. 1 after proper identification and verification subject to furnishing of indemnity bond of like amount.
4. With the above observations, the I.A. stands disposed of.
