ORDER

Date : 23-09-2026

Heard Mr. A. Das, learned counsel for the petitioner. Also heard Mr. P. Kakati, learned Special PP, appearing for the Vigilance Cell assisted by Ms. A. Lala, learned counsel.

2. The petitioner, who is serving as Sub-Divisional Engineer, APDCL, Tamulpur Page No.# 2/2 Electrical Sub-Division, has received a notice for appearance before the Vigilance Cell, but he could not appear on 18.09.2026. But he undertakes to appear in compliance with the same, but he apprehends that he may be arrested, though he does not have particulars of any criminal case pending against him on non- bailable penal provisions.

3. It is submitted that on 10.09.2026, the petitioner had already appeared and was asked to appear again on 18.09.2026, on which date he could not appear due to some religious function on the previous day, and that he wishes to appear before the authority now.

4. Mr. P. Kakati, learned Special PP submits that only a preliminary inquiry is in process, and no criminal case has been registered as yet. Therefore, the apprehension of the petitioner is baseless at this stage. The learned Special PP also submits that the petitioner has been summoned only as a witness, and he has already appeared earlier.

5. In view of the aforesaid projected facts and circumstances, this petition is disposed of with the observation that - to continue rendering his co-operation to the preliminary inquiry said to be in progress - the petitioner shall appear before the summoning authority again and render his co-operation to the same. However, as criminal case has not yet been registered, such appearance by way of participation as a witness in the Preliminary Inquiry (Allegation No. 111 of 2026) shall not subject him to any coercive action. Anticipatory bail application stands disposed of on the aforesaid terms. JUDGE Comparing Assistant
