Page No.# 2/2

2. This petition under Section 483 of the BNSS, 2023 has been filed by the accused-petitioners, namely, Sahab Ali and Md. Iftikar Saikia, praying for grant of bail in connection with Paltanbazar P.S. Case No.245/2026 under Sections 140(2)/3(5) of the BNS Act. They were arrested on 10/9/2026.

3. In the instant case which was registered on the basis of a complaint dated 9/9/2026 lodged by the elder sister of the victim purportedly a minor was allegedly kidnapped by some unknown persons.

4. From the forwarding report it is revealed that the victim was subsequently recovered from the possession of the accused persons namely Sahab Ali and Iftikhar Sakia, who are the petitioners in this case.

5. The learned counsel submits that there was some monetary dispute with the family member of the victim and subsequently, this alleged incident took place. He further submits that the petitioners are not involved in kidnapping the minor boy.

6. The case diary has been received.

7. Learned Additional Public Prosecutor submits that there was an attempt to extort more than Rs.2,00,000/- in lieu of release of the boy and subsequently, it was settled at Rs.20,000/-. The investigation has revealed that the accused persons in a planned manner committed kidnapping of the boy for ransom. The investigation prima facie reveals that this is an offence of kidnapping for ransom but due to information to the police, they were apprehended.

8. There are materials to indicate that there was an attempt to kidnap a minor to demand ransom from his family and subsequently, came to be executed in the aforesaid manner. Investigation is in progress. At this stage it might be prudent to refuse bail.
