ORDER
Date : 18.09.2026 Heard Mr. T. Chutia, learned counsel for the petitioner. Also heard the learned Additional Public Prosecutor appearing for the State. By this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner, namely, Ajibur Rahman, has prayed for grant of pre-arrest bail in connection with Khetri P.S. Case No.94/2026 under Sections Page No.# 2/2 303(2)/317(2) BNS, 2023, R/W Section 11(1)(a)(d)(e)(h) of Prevention of Cruelty to Animal Act, 1960 R/W Section 13(1) of the Assam Cattle Preservation Act, 2021. Case diary as called for has been received. The petitioner is the owner of the 32 nos. of cattle that was intercepted by the police while being transported by the co-accused person. It appears from the order dated 05.09.2026 passed by the learned Additional Chief Judicial Magistrate, Kamrup(M), in Khetri P.S. Case No.94/2026 that the custody of the cattle has been handed over to its owner upon verification of the valid documents relating to purchase of the said cattle thereby, indicating prima facie that the cattle were not stolen goods. Having regard to the above, the prayer for pre-arrest bail of the petitioner is allowed. Accordingly, it is provided that in the event of arrest of the accused petitioner named above in connection with Khetri P.S. Case No.94/2026 under Sections 303(2)/317(2) BNS, 2023, R/W Section 11(1)(a)(d)(e)(h) of Prevention of Cruelty to Animal Act, 1960 R/W Section 13(1) of the Assam Cattle Preservation Act, 2021, he shall be enlarged on pre-arrest bail on furnishing bail bond of Rs. 50,000/- (Rupees fifty thousand) only with two local sureties of like amount to the satisfaction of the arresting authority. Anticipatory bail application stands disposed of.
