ORDER

The instant application is filed under Order 41 Rule 5 read with Section 151 of the CPC praying for stay of the operation impugned judgment and award dated 29.05.2025, passed by the learned Member, MACT, Barpeta, Assam in MAC Case NO.156/2019. Heard the learned counsel for the applicant and also heard the learned counsel for the respondent. The learned counsel for the applicant submits that the applicant has already preferred an appeal against the impugned judgment and award dated
29.05.2025, passed by the learned Member, Barpeta in MAC Case No.156/2019 and the said appeal is admitted by this Court. In the event that the impugned judgment is not suspended during the pendency of the appeal, the applicant will suffer irreparable loss and injury to the applicant. In view of the circumstances stated above, the impugned judgment and award dated 29.05.2025, passed by the learned Member, MACT, Barpeta in MAC Case No.156/2019 shall remain suspended till the disposal of the connected appeal subject to the condition that the applicant shall deposit 50% of the awarded amount before the Registry of this Court within 6 weeks from today.
