ORDER

12.09.2026 Mr. Sanjib Bhattacharjee, the applicant in IA(Civil) No. 1116/2026, who has filed the Interlocutory Application for condonation of delay of 9 days in filing the appeal against the judgment and order dated 23.09.2025 passed by the learned MACT, Dhubri, in MAC Case No. 94/2019(I), is present before this Court. Ms. Hena Haflongbar, the legal representative of the New India Assurance Company Limited. It has been submitted that the parties have come to a settlement for an additional amount of Rs.1,50,000/- over and above the compensation granted by the learned Tribunal. In view of the settlement arrived at, the present interlocutory application praying for condonation of delay in MAC Appeal No. 96/20226 would not require any further consideration and is accordingly closed. The connected MAC appeal also does not require to be processed in view of the settlement arrived at by and between the parties. Accordingly, the insurance company shall now deposit the additional amount of Rs. 1,50,000/- into the bank account of the claimant, the details of which shall be furnished before the Registry of this Court within a period of 6 weeks from today, which shall be disbursed to the claimant in accordance with the notification no. 43 dated 26.06.2020. This MAC Appeal is accordingly disposed of. The copy of the settlement shall be kept on record. JUDGE Comparing Assistant
