Heard Mr. I. Ahmed, the learned counsel for the applicants. Mr. Z. Hammad, the learned counsel appears on behalf of the writ petitioners and Ms. M. Barman, the learned Government Advocate appears on behalf of the State respondents.
2. This is an application filed by the applicants claiming that they are the owners of the land upon which the writ petitioners are claiming compensation in respect of the land acquisition.
3. It is relevant to take note of that the acquisition has been carried out under the Asom Mala Project which is a scheme of the Government of Assam to acquire land on the basis of an agreement.
4. Considering the above, as there is an inter se dispute as regards the title of the land which is said to be acquired under the Asom Mala Project, this Court is of the opinion that the applicants herein are necessary parties to the accompanying writ petition.
5. Accordingly, this Court impleads the applicant Nos. 1 to 7 as the respondent Nos. 5 to 11 to the accompanying writ petition.
6. The learned counsel for the writ petitioners is directed to file a fresh Memo of Parties before the Registry of this Court within three days, and the Registry on the basis of the fresh Memo of
Parties as well as the instant order,shall make necessary correction in the cause title and update the same in the CIS.
7. With the above, I.A. stands disposed of.
