Heard Mr. J. Singh, learned counsel for the applicant who submits that he has received instruction from the applicant to withdraw this appeal without Page No.# 2/2 prejudice to the right of the accused to pray for bail. Mr. R.K.D. Choudhury, learned Dy.SGI for the respondents and he has submitted a compilation of cases on the issue. The same is made a part of record. Mr. K. Gogoi, the learned Amicus Curiae has also submitted his views together with a compilation of case laws on which he intends to rely upon. The effort of the learned Amicus Curiae is appreciated. The said compilation is made a part of record. The issue raised in the connected reference shall be answered in a appropriate case. Accordingly, without prejudice to the right of the accused to pray for bail, this application stands dismissed on withdrawal. Consequently, the connected un-numbered appeal also stands dismissed.
