ORDER

28.08.2026 Heard Mr. P. K. Saharia, learned counsel for the petitioner. Also heard Mr. D. P. Goswami, learned Additional Public Prosecutor for the State.

2. This application has been filed under Section 483 BNSS, seeking bail of the petitioner, namely, Sanjan Debnath, who was arrested on 03.05.2026 in connection with Rowta P.S. Case No. 25/2026 under Section 65(1) of BNS.

3. The learned counsel for the petitioner fairly submits that he is not much on the merits of the matter but rather continuing that the petitioner has been in custody for more than 100 days, since his arrest on 03.05.2026, and in the meantime, investigation is also completed, and the case was poised for commencement of trial.

4. Scanned TCR is available.

5. The allegation in the ejahar is about commission of sexual assault upon the 12 year old daughter of the informant while he and his wife were not there. The accused is alleged to be a friend of the informant.

6. The prosecution opposing the bail has drawn attention of the Court to the statement of the alleged victim girl recorded during investigation before the learned Magistrate. I have perused the said statement in which she has implicated the petitioner and described in detail about the incident.

7. Ms. B. Sarma, the learned Amicus supporting the opposition of the prosecution to grant of bail, further submits that there is possibility of intimidation of the minor girl who is aged only 12 years and that the accused also happens to be a person of a known circle being a friend/acquaintance of her father.

8. I have considered the materials and the submissions. At this stage the bail petition stands rejected.

9. However, it is hoped that the learned Trial Court shall endeavour to complete the trial expeditiously.
