Heard Mr. N. Hasan, learned counsel for the accused petitioner and Mr. P. Borthakur, learned Additional Public Prosecutor for the State.

2. This is an application under Section 482 of the BNS, 2023 praying for granting pre-arrest bail to the accused-petitioner in connection with Barekuri P.S. Case No. 02/2026 under Section 303(2) of the BNS, 2023 read with Section 3(2) (b) of the Prevention of Damage to Public Property Act, 1984 read with Section 15(2) of the Petroleum and Minerals Pipelines (Acquisition of Right of User in Land) Amendment Act, 2011.

3. The FIR was lodged from the security department of Oil India Limited with allegations about a joint operation conducted along with Tinsukia police, whereupon 1750 litres of condensate oil was found along with empty gallons, hosepipe, and a Tata Yoda vehicle AS-02-CC-7389. The FIR alleges involvement of a well-organised nexus of gangs in illegal pilferage of oil in this area.

4. The case diary has been received.

5. The learned counsel, Mr. Hassan submits that the petitioner denies his involvement in the alleged offences and that he is the owner of the said vehicle mentioned in the FIR, which he had given in good faith to two persons named Raja Moran and Manash Khaund who were arrested in this case and later released on bail.

6. On the other hand, the learned Addl. P.P. on the basis of the investigation revealed through the case diary submits that, as alleged in the FIR, the investigation has also found involvement of a wider organized group in these kinds of illegal activities and that there are direct and significant implications against the present petitioner.

7. It is also submitted by the prosecution that the present petitioner is has been found by the investigation to be one of the main persons involved in this racket and against whom other criminal proceedings also pending.

8. In the given facts and circumstances, it may not be prudent to grant anticipatory bail to the petitioner, at least at this stage, as the investigation is still going on.

9. In such view of the matter, the bail petition stands rejected at this stage.

10. Return the case diary.
