ORDER

24.08.2026

1. Heard Mr. M. J. Baruah, learned counsel for the petitioners. Also heard Mr. S. P. Choudhury, learned counsel for the respondent.

2. The present contempt petition is filed against willful and deliberate violation of order dated 22.01.2024 passed in WP(C) No. 5406/2023.

3. The aforesaid order is reproduced herein below:- “Dated: 22/01/2024 Mr. M.J. Baruah, leaned counsel for the writ petitioners submits that although there was an assurance given by the learned counsel for the respondents protecting the interest of not only the Junior Assistants and Senior Assistants but also the Technical and Senior Technician, yet, the same does not find mention in the order dated 24/11/2023 passed by this Court, thus, giving rise to an apprehension in the mind of those petitioners, who are working as Technicians and Senior Technicians. Responding to the above, Mr. S. P. Choudhury, learned counsel for the respondents submits that at this moment, the apprehension expressed by the petitioner’s counsel is unfounded since there is no move on the part of the authorities to initiate any adverse action against the Technicians as well as the Senior Technicians. In view of the above, no further order is required to be passed in this case for the present. If the members of the petitioner’s organization, at any stage, feels aggrieved in the matter, in any manner, it would be open for them to file appropriate application, seeking relief from this Court. Let this matter be listed again on 29/02/2024, as a fixed item along with WP(C) 5046/2023. In the meantime, the respondents’ counsel to file affidavit”.

4. It is submitted at the bar that the aforesaid writ petition being WP(C) No. 5406/2023 has already been disposed of.

5. In view of the above, nothing survives to the adjudicated in the present contempt petition.

6. Accordingly, this contempt petition stands closed. JUDGE Comparing Assistant
