Mr. PK Sharma, the learned counsel appearing on behalf of the petitioner submits that he has instruction to withdraw the instant writ petition with liberty to re-file.

2. The learned counsel for the petitioner further submits that certain new materials have come to light which would be required to be brought on record and taking into account that the same being new plea, the petitioner cannot bring the same by way of an additional affidavit and accordingly there would be a requirement for withdrawal of the writ petition with a liberty to re-file.

3. Ms. A Gayan, the learned CGC submits that she has no objection to the above prayer.

4. Taking into account the above, the writ petition stands closed on withdrawal.
