ORDER

Date : 12.08.2026

Heard Mr. H. Das, learned counsel for the applicant. Also heard Mr. N. Upadhaya, learned Standing Counsel for the Irrigation Department, Government of Assam, representing respondents No. 1, 2, 3 and 4, Mr. D. Borah, learned State counsel for the respondent No. 5 as well as Ms. S. Sarma, learned counsel appearing on behalf of Mr. B. Sarma, learned Standing Counsel for the Accountant General (A & E), Assam, representing the respondent No. 6.

2. This is an application praying for impleadment of the Secretary to the Government of Assam, Finance Department, Dispur, as respondent No. 7 in the connected WP(C)/2458/2025.

3. The applicant was engaged as Muster Roll worker in the year 1997 under the Executive Engineer, Karimganj Division, Karimganj district (now Sribhumi) has filed the connected writ petition for regularization of the service and for payment of consequential retirement benefits.

4. Mr. H. Das, learned counsel for the applicant submits that while filing the writ petition, inadvertently, the Finance Department which required to be impleaded, has not been arrayed as party-respondent although the Department of Finance would be a necessary party.

5. Having considered the nature of the grievance raised in the connected writ petition to the effect of seeking regularization of the service of the applicant/petitioner with consequential benefits as Muster Roll worker, and considering that the prayer for impleadment not being opposed by the learned counsel for the respondents, I deem it appropriate to allow this application as the party i.e. Finance Department, which is sought to be impleaded, would be a necessary party for proper adjudication of the issue involved in the connected writ petition.

6. Accordingly, the Secretary to the Government of Assam, Finance Department, Dispur, Guwahati, is allowed to be impleaded as party-respondent No. 7 in the aforesaid connected writ petition.

7. Accordingly, the interlocutory application stands allowed and disposed of. JUDGE Comparing Assistant
