ORDER

31.07.2026

Heard Mr. M Beria, the learned counsel appearing on behalf of the petitioner.

2. The present application has been filed alleging willful and deliberate violation to the order dated 28.08.2025 passed in IA(C)No.1963/2025 arising out of Title Suit No.2974/2025.

3. It is the case of the petitioner herein that there was an undertaking given by the respondent herein that the respondent would be present and ready to sign the cheque for withdrawal of money and this undertaking has been violated.

4. This Court has duly perused the application and is of the opinion that the instant application is not maintainable inasmuch as there cannot be initiation of contempt proceedings against a non-natural person.

5. Accordingly, the contempt proceedings stands dismissed.

6. The dismissal of the instant petition shall not preclude the petitioner to file an application initiating contempt proceedings against the persons, who are responsible and conducting the business on behalf of the respondent herein.
