Heard Mr. M. J. Baruah, the learned counsel appearing on behalf of the Petitioner. Ms. N. Bordoloi, the learned counsel appears on behalf of the Revenue Department; Mr. S. Borah, the learned counsel appears on behalf of the GMC and Mr. M. Bhuyan, the learned counsel appears on behalf of the PWD (Roads).

2. Mr. M. J. Baruah, the learned counsel for the Petitioner submitted that taking into account the stand which has been taken by the Respondent Authorities to the effect that only the land covered by Dag No.1381 (new) has been used for the purpose of construction of the road and disputed questions arise as to whether it is the land of the Petitioner wherein construction has been carried out, the Petitioner would not like to pursue the present proceedings. The learned counsel for the Petitioner, however, submitted that the withdrawal of the instant writ petition should not affect the rights of the Petitioner to approach the competent Court of Civil Jurisdiction or the appropriate forum, if so advised.

3. Taking into account the above, the instant writ petition stands closed on withdrawal.

4. Liberty is granted to the Petitioner to approach the appropriate forum, if so advised.
