ORDER

31.07.2026

Heard Mr. S.R.A. Naser, learned counsel for the petitioner; Mr. A. Das, learned counsel on behalf of Ms. R. Bora, learned Standing Counsel, Agriculture Department for the respondent nos. 1 & 2; Mr. B. Deka, learned Standing Counsel, Assam Information Commission for the respondent no. 3; and Mr. S.S. Roy, learned Junior Government Advocate, Assam for the respondent no. 4.

2. The grievance raised by the petitioner in the present writ petition is non-consideration of four nos. of appeals preferred by the petitioner under Section 19[3] of the Right to Information Act, 2005 [‘the RTI Act’, for short] by the Assam Information Commission.

3. When the writ petition was listed on 17.07.2026, Mr. Deka, learned Standing Counsel, Assam Information Commission was requested to obtain instruction as regards the status of the four appeals, as mentioned by the writ petitioner in this writ petition.

4. Today, Mr. Deka, on the basis of instructions he has received, has submitted that the four appeals have been registered on 08.05.2026 and the appeals are going to be considered for disposal as expeditiously as possible. On a query by the Court, Mr. Deka has submitted that the Assam Information Commission is, at present, functioning with two Information Commissioners.

5. In view of the above instructions placed by Mr. Deka that the four appeals, filed by the petitioners, have already been registered for consideration by the Assam Information Commission and the Assam Information Commission is functioning with two Information Commissioners, as on date, this writ petition is disposed of with the observation that the Assam Information Commission shall consider and dispose of the four appeals filed by the petitioners in accordance with the provisions of the RTI Act, as expeditiously as possible, preferably within a period of three months from today.
