O R D E R
29.07.2026
Heard Mr. M. U. Mondal, the learned counsel appearing on behalf of the Petitioner. None appears on behalf of the Cooperation Department on call. Mr. B. Sinha, the learned counsel appears on behalf of the Respondent No.6.
2. Mr. B. Sinha, the learned counsel who was appearing for the Respondent No.6 submitted that the Respondent No.6 had expired on 12.05.2025.
3. The present writ petition has been filed by the Petitioner assailing the order dated 21.06.2024 issued by the Registrar of Cooperative Societies, Assam as well as the impugned letter dated 29.06.2024 issued by the ARCS, Karimganj and the consequential orders.
4. This Court duly takes note of that the order dated 21.06.2024 passed by the Registrar of the Cooperative Societies had upheld the decision of the Board of Directors dated 01.02.2023 for re-induction of the Respondent No.6 as the Secretary of the Respondent No.5.
5. As the Respondent No.6 in the meantime had expired, the impugned orders no longer survives. The consequential orders which were based upon the impugned order dated 21.06.2024 also cease to exist in view of the fact that the order dated 21.06.2024 cannot hold the field as on date.
6. Accordingly, the instant writ petition challenging the order dated 21.06.2024 as well as the other consequential orders have become infructuous.
7. Mr. M. U. Mondal, the learned counsel appearing on behalf of the Petitioner submitted that there would be now a requirement of the Board of Directors of the Respondent No.5 to select and appoint a fresh Secretary.
8. Taking into account the said submission, this Court observes that as the instant writ petition has become infructuous, the Board of Directors of the Respondent No.5 would be at liberty to take steps for selection and appointment of a Secretary as per the provisions of the Assam Cooperative Societies Act, 2007, the Rules framed thereinunder as well as the bylaws of the Society.
