Heard Mr. B.D. Das, learned senior counsel assisted by Mr. H.R. Das, learned counsel for the applicant. Also heard Ms. N. Bordoloi, learned Standing Counsel, Revenue Department; Mr. J. Handique, learned State Counsel and Mr. G. Choudhury, learned counsel appears for the respondent No.4. This is an application praying for striking out the name of the respondent No.5 i.e., the Chairman, Assam Land Advisory Committee, District Kamrup(M) in the connected WP(C) 4456/2021. It is submitted by the learned senior counsel that the respondent No.5 is no longer exist and therefore, the respondent No.5 is not required to be made a party respondent in the connected writ petition. Having considered that the Office of the Chairman, Assam Land Advisory Committee, Kamrup appears to be not in existence and as agreed to by the learned counsel for the parties, I deem it appropriate to allow this application by striking out the name of the respondent No.5, i.e. The Chairman, Assam Land Advisory Committee, Kamrup from the array of party respondent No.5 in the connected writ petition.
