ORDER

Date : 04.06.2026

Heard Mr. M. A. Islam, learned counsel for the petitioners.

By filing this writ petition, the petitioner has prayed for a direction to the respondent authorities to grant sale permission in respect of a plot of land measuring 1 Bigha 1 Katha 9 Lechas, covered by Dag No. 2, Patta No. 86, situated at Village Bhashanigaon, under Bilasipara Revenue Circle, District Dhubri, Assam.

The respondent authorities filed an affidavit which reflects that, after examination and consideration of the application for sale permission, the matter was placed before the Additional Deputy Commissioner, who, by an order dated 15.02.2026, has rejected the application of the petitioner.

In view of above, Mr. Islam, learned counsel for the petitioners, submits that he may be allowed to withdraw this writ petition with a liberty to file afresh challenging the rejection order dated 15.02.2026.

Mr. A. Bhattacharjee, learned Standing Counsel, Revenue Department, and Mr. H. Sarma, learned State Counsel, are present. Accordingly, writ petition stands closed on withdrawal with a liberty to the petitioners to file afresh against the order of rejection dated 15.02.2026, if so advised.
